Methelus, et al. v. School Bd. of Collier Cnty., Florida, No. 16-CV-00379 243, F.Supp.3d 1266 (M.D. Fl. 2017)

English language learners sued the School Board of Collier County, FL, alleging that they were excluded from a free public education. The plaintiffs made allegations under the Equal Educational Opportunities Act of 1974 (EEOA) and the Florida Education Code, claiming that the school board denied them equal access to educational opportunities through policies that excluded them from public school enrollment. Defendants filed a counterclaim, arguing that the EEOA doesn’t preempt Florida’s education requirements. The court concluded that the defendants’ counterclaim didn’t demonstrate a factual injury and granted plaintiffs’ motion to dismiss the counterclaim.
